Buying a Phuket Show Villa: Control Continued Developer Use
If a developer offers to sell you a Phuket show villa while continuing to use it for viewings, assess two arrangements: the purchase and the proposed occupation after purchase. A furnished presentation can make the home easy to imagine living in, but visitors, staff access and delayed possession can change its value to you.
Define exactly what remains in use
Ask for the proposed dates, daily access hours, permitted activities and named operating entity. Distinguish occasional accompanied visits from a staffed sales office, events or overnight occupation. Identify who holds keys and whether visitors may enter every room, use the pool or park on the property. Treat these as proposed terms requiring agreement, not established developer rights.
List all furniture, artwork, appliances and demonstration equipment included in the sale. Some display items may belong to suppliers. Record condition with an independent inspection and dated photographs. Establish which warranties remain available and which items have already been used extensively.
Put the arrangement through independent review
The GOV.UK guidance on buying abroad recommends independent legal advice. Have Thai-qualified counsel review ownership, the proposed use arrangement, responsibility for injury or damage, insurance, utilities, maintenance and any applicable permissions. Do not assume a sales-use agreement is automatically covered by a residential insurance policy.
If compensation is proposed, compare the documented net amount with the loss of personal use and alternative lawful letting. Specify payment evidence, security if negotiated, default procedures and the end date. A promised payment is a counterparty commitment, not guaranteed investment income. Do not accept an indefinite extension tied only to the developer selling its remaining inventory.
Plan the final return of the home
Agree an inventory check, repairs, cleaning, removal of signs and sales equipment, and return or replacement of access credentials. Ask counsel to define enforceable remedies and the relationship with the purchase agreement.
