An auction does not remove the usual foreign-buyer eligibility checks. Confirm the unit's current quota position and transfer documents before you bid.
Short answer: before bidding on a Phuket condominium, ask the Land Office and an independent Thai lawyer whether you can register that specific unit in the intended ownership category. The Condominium Act's foreign-ownership limit is measured against total unit area, and the unit's available quota can change. An auction notice or winning bid does not by itself confirm that a foreign transfer can be registered.
Check the unit and your buyer file
Obtain the current unit details, title reference and written confirmation of the condominium's foreign-ownership position. The Department of Lands guide and its English Condominium Act translation describe statutory conditions and the area-based foreign ownership ceiling. Those references are not a unit-level quota certificate.
Ask the Land Office what source-of-funds, identity, bank and supporting documents the intended buyer must show at transfer. Match names and the intended owner across registration, auction paperwork and the money trail. If the auction bidder, remitter and proposed registered owner differ, get written professional advice before bidding. Do not assume a workaround or change in buyer is allowed after a winning bid.
Also read the lot's payment and transfer conditions. Set a deadline for answers that leaves time before registration; if eligibility remains unclear, do not treat the starting price as a reason to proceed. Fact-check flags: the Act, Land Office practice, foreign quota and acceptable funding evidence may change or depend on the case. Confirm the current rule and exact unit position with the Phuket Land Office and an independent Thai lawyer. This article is not a legal opinion or a guarantee of transfer.
