Phuket Off-Plan Contract Assignment: Exit Before Completion

Phuket Off-Plan Contract Assignment: Exit Before Completion

Check assignment consent, buyer eligibility, fees, payment status, marketing limits, timing and fallback exit routes.

A reservation is not automatically transferable

Before buying off-plan, ask whether the contract can be assigned before completion and registration. Identify developer consent, buyer eligibility, payment status, notice periods, forms, taxes or fees, marketing restrictions and the point after which assignment closes. Separate a contractual assignment from a completed-unit resale.

Model the exit using documented completed transactions, not advertised premiums. Keep a fallback plan if consent is refused, the replacement buyer fails screening or completion arrives first. Independent Thai counsel should review the contract and current transfer consequences. Read the reservation guide, completion-date guide and buyer service.

Fact check

Assignment rights, consent, fees, tax, foreign-buyer eligibility, advertising and remedies depend on the contract, project and current Thai law. Obtain independent advice.
