Buying a home with a Thai spouse requires clarity about whose name will appear on the title and what documents the Land Office may require. Thailand’s official information explains that property registered in a Thai spouse’s name is treated as belonging to the Thai national. Do not assume that contributing money creates a registered ownership share for the foreign spouse.
Before signing or transferring funds, tell an independent Thai property lawyer the intended ownership, marital status, source and path of each contribution, and whether the asset is a condominium or land-and-house arrangement. Ask the lawyer to identify the exact Land Office declarations, bank evidence, marriage records and translations that apply to this transaction. Do not use a nominee or side agreement as a substitute for a lawful ownership structure.
For a condominium, separately verify the unit title, project foreign-ownership quota and required transfer-fund evidence. For land or a villa, obtain advice on the land title, house ownership, lease or other registered rights; these are not interchangeable. Ask how inheritance, separation, sale, refinancing and one party’s death would be handled, and have the advice recorded before committing.
Keep source-of-funds records, bank transfer receipts, signed agreements and Land Office documents together. Translate key terms before signing and make sure each spouse understands any declaration about ownership or marital property. A general online guide cannot determine the rights created by a particular title or agreement.
