A rooftop terrace can be an attractive part of a Phuket property offer, but the word private does not establish its legal status. Before paying for the extra space, identify the rights offered, permitted use, maintenance responsibilities and the route to reach it.
Connect the advertisement to the documents
The Royal Phuket Marina penthouse description illustrates rooftop dining space in local property marketing. It is not proof of the rights attached to another unit. Ask for the relevant title, approved plans and agreements, then have independent Thai counsel explain whether the terrace forms part of the property, common space with specified use rights or another arrangement.
For an off-plan offer, match the terrace to the signed drawings and specification. Record included surfaces, lighting, water points, shade structures and equipment. Do not treat a rendering of a furnished roof as a commitment to provide every displayed item.
Check access and maintenance
Walk the permitted route from the living area to the terrace. Note stairs, doors and access required by building staff. Ask who maintains waterproofing, drainage and services, and who pays if work affects the apartment below. Request relevant records and an independent technical inspection.
Do not add a hot tub, heavy planters, shade structures or an outdoor kitchen without appropriate technical and permission checks. Existing equipment also needs verification; its presence does not prove approval or adequate structural capacity.
Value realistic use
Visit at the times you expect to use the space and assess privacy, weather exposure and the trip back indoors. Compare the full purchase and maintenance cost with an ordinary apartment and usable balcony. Any rental case should rely on lawful use and relevant evidence, not just impressive rooftop photographs.
