Vacant Possession in Phuket: Plan the Final Resale Walk-Through
If you are buying a Phuket resale to move into immediately, agree what vacant possession means in your contract and how it will be evidenced. An empty room during a viewing does not establish that every occupant, booking or right to use the property has ended. Ask an independent Thai-qualified lawyer to connect the agreed move-out arrangement with the closing timetable.
Identify everyone using the home
Ask the seller to disclose tenants, family occupants, staff accommodation, stored belongings and future guest bookings. Have your adviser review any occupancy agreement and the evidence needed for its lawful conclusion. Do not assume a sale automatically removes another person’s rights or authorises you to change locks.

Define the handover condition
Attach the agreed furniture inventory and distinguish included equipment from items the seller will remove. Set expectations for rubbish, personal belongings, cleaning and damage caused during removal. For a Rawai villa, include storage and staff areas; for a condo in Kamala, include any allocated storage and access devices.
Arrange a final walk-through close to completion. Record who attended, dated photographs taken with permission, meter readings, missing items and visible changes since the earlier inspection. Check that included appliances remain present and arrange technical checks where appropriate. Keep unresolved defects separate from the question of whether the home is actually available to occupy.
Agree what happens if it is not ready
Before signing, ask counsel to explain the available contractual options if an occupant remains or agreed items have disappeared. Any postponement, retention or other remedy must be properly agreed; do not invent a right to withhold payment on closing day. Have a practical accommodation contingency if your flight arrives before possession is confirmed.
